Terms of Service

These terms govern your use of cloudmarktplaats.nl (the "platform"). By creating an account or using the platform, you agree to these terms. This is an English courtesy translation; the Dutch version prevails in case of any discrepancy.

1. Who we are

The platform is operated by Aldewereld Consultancy, postal address Nieuwe Hemweg 26, 1013 CX Amsterdam, the Netherlands (mail only; visits by appointment), registered with the Dutch Chamber of Commerce under number 61862533. Contact: info@cloudmarktplaats.nl.

2. What cloudmarktplaats is — and isn't

Cloudmarktplaats is a peer-to-peer marketplace where users offer, find and get in touch about used IT hardware. The platform is open source (AGPL-3.0) and built to be privacy-friendly.

We are an intermediary, not a party to the sale. Any agreement about a listing is concluded directly between buyer and seller. We are not a party to it, do not inspect the goods, and give no warranty as to the quality, authenticity, safety or delivery of items, or the reliability of users. Use of the platform and entering into transactions is at your own risk.

3. Free to use

The platform is free. We charge no commission, listing fees or transaction fees. Sponsorship and donations are voluntary.

4. Your account

• You are responsible for the accuracy of your details and for keeping your credentials secret. Secure your account; we recommend two-factor authentication (2FA).
• You are responsible for everything that happens through your account.
• You create at most one account per person and do not act on someone else's behalf without their consent.

5. What you post

You are responsible for the listings, photos, homelab posts and messages you post. You confirm that you are entitled to sell the items offered and to post the content.

Prohibited in particular:

• Offering illegal, stolen or dangerous goods, or goods whose sale is legally restricted.
• Misleading, fraudulent or spam listings.
• Content that infringes others' rights (copyright, trademark, image rights) or that is unlawful, threatening or offensive.
• Posting other people's personal data without a legal basis.

We may review listings before publication (moderation) and refuse, edit or remove content or accounts that breach these terms.

6. Contact between users

Messages to a seller are sent through a one-off relay email. We do not store the contents of those messages and do not keep your email address. See the Privacy Policy.

7. Acceptable use

You will not use the platform to overload, abuse or disrupt it. Prohibited actions include automated scraping beyond normal use, circumventing security or rate limits, and attempts to gain unauthorised access. The software is open source; you may fork and self-host it under the AGPL-3.0, but that does not grant any right to misuse this service or other users' data.

8. Intellectual property

Content you post remains yours. You grant us a non-exclusive, royalty-free licence to display and process that content as needed to operate the platform (for example, showing your listing and photos). The platform software is available under the AGPL-3.0.

9. Liability

To the extent permitted by law, our liability is limited or excluded. We are not liable for damage arising from transactions between users, from user content, or from unavailability of the platform. Nothing in these terms excludes liability that cannot be excluded under mandatory law (such as intent or wilful recklessness).

10. Termination

You may close your account at any time. We may suspend or terminate access to (part of) the platform in case of a breach of these terms or abuse.

11. Changes

We may amend these terms. When a new version is published, we will ask you to agree again before you perform a legally relevant action (such as posting a listing). The current version is always on this page.

12. Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in Amsterdam, unless mandatory law designates another court.
